दलहरुबिच शान्ति प्रक्रिया टुङ्ग्याउने ऐतिहासिक सहमति, माओवादीका छ हजार पाँच सय लडाकु समायोजन गरिने

काठमाण्डौँ । दलहरु बिच शान्ति प्रक्रियालाइ टुङ्गोमा पु¥याउने ऐतिहासिक सहमति कायम भएको छ । शिर्ष तिन दल बिच आज बालुवाटारमा भएको वार्तामा माओवादी लडाकुको समायोजन सहित शान्ति प्रक्रियाको बाँकी काम सम्पन्न गर्ने सहमति भएको हो । यद्यपी शिर्ष तिन दल बिच सहमति कायम भएपछि मधेशी मोर्चालाइ पनि छलफलमा सहभागी गराइएको थियो । 

दलहरु बिच भएको सहमति लाइ शान्ति प्रक्रिया लगायतका विषयमा राजनीतिक दलहरुको सहमति भनेर उल्लेख गरिएको छ । सहमपति पत्रमा एकीकृत नेकपा माओवादीका अध्यक्ष पुष्पकमल दाहाल प्रचण्ड, नेपाली काँग्रेसका सभापति शुशिल कोइराला, नेकपा एमालेका अध्यक्ष झलनाथ खनाल र मधेशी मोर्चाको तर्फबाट विजय कुमार गच्छदारले हस्ताक्षर गर्नु भएको छ । 

दलहरु बिच भएको सहमतिमा समायोजनमा सामेल हुने माओवादी सेनाका लडाकुहरुको संख्या बढीमा छ हजार पाँचसय सम्म हुने उल्ल्ेख छ । दलहरु बिच भएको सहमतिमा भनिएको छ ः समायोजन नेपाली सेना अन्तर्गत महानिर्देशनालयमा हुनेछ । त्यसमा सुरक्षा निकायबाट ६५ प्रतिशत र माओवादी सेनाका लडाकुहरुबाट ३५ प्रतिशतको संख्या रहनेछ ।  महानिर्देशनालयको कार्य विकास–निर्माण, बन सुरक्षा, औद्योगिक सुरक्षा र विपद् व्यवस्थापन हुनेछ ।  

त्यस्तै दलहरु बिच पुनस्थापानामा जान चाहने लडाकुहरुका लागी शिक्षा, तालिम एवं व्यवसायिक अवसरहरुको रु. ६ देखि ९ लाखसम्मका प्याकेजको विकल्प उपलब्ध गराउने र नगद रकम लिई स्वैच्छिक अवकाशमा जानेहरुका लागि विभिन्न तहको जिम्मेवारी हेरी सबभन्दा माथिल्लो तह तथा त्यसभन्दा तल तीन तह निर्धारण गरिनु का साथै सबभन्दा माथिल्लो तहका लडाकुहरुलाई रु. ८ लाख एवं त्यसपछिका तहमा रहेकाहरुलाई क्रमशः रु.७ लाख, रु.६ लाख र रु.५ लाख   दिइने उल्लेख छ । यद्यपी रकम दुई आर्थिक वर्षमा दुई किस्तामा उपलब्ध गराईने सहमति पत्रमा जनाइएको छ । दलहरु बिच भएको सहमति पत्र जस्ताको तस्तै पढ्न तल आउनुहोस् ।

दलहरु बिच भोली नै सेना समायोजन विषेश समितीको बैठक बोलाएर बाँकी कार्य अगाडी बढाउने निणर्य भएको छ । सेना समायोजन विषेश समितीको बैठक भोली दिउँसो दुइ बजेका लगाी बोलाइएको छ । आजको सहमति अनुसार आउँदो मंसिर ७ गते भित्र समायोजनमा जाने लडाकुहरुको समुह विभाजन गरिने उल्ल्ेख छ । 

त्यस्तै दलहरु बिच यसअघि भएका सहमति अनुसारका आयोग हरु गठन गर्ने, द्धन्द्ध पिडितलाइ राहत सअयोग गर्ने, विगतका सहमतिको कार्यन्वयन र विश्वासको वातावरण सिर्जना गर्ने, संविधान निमार्ण र राष्ट्रिय सहमतिको सरकार गठन गर्ने पनि सहमति भएको छ । 

बैद्य पक्षको विरोध

यसैबिच एकीकृत नेकपा माओवादीका बरिष्ट उपाध्यक्ष मोहन बैद्यले दलहरु बिच भएको सहमतिको विरोध गर्नु भएको छ । दलहरु बिच भएको सहमति एमाले नेता भिम रावलले पढेुर सुनाए लगत्तै उपाध्यक्ष बैद्यले आफुहरुको असहमति रहेको बताउनु भएको हो । उहाँले दलहरु बिच आज भएको सहमति पार्टिको केन्द्रीय कमिटी निणर्य विपरित रहेको भन्दै विरोध जनाउनु भयो । बैद्य पक्षले भोली बुधबार यसबारेमा पत्रकार सम्मेलन गरि औपचारिक रुपमा असन्तुष्टि जाहेर गर्ने जनाएको छ । बैद्यले जनवादी केन्द्रीयताको विचार अनुसारको विचार बैठकमा समेत राखेको बताउनुभयो । 

बैठक पछि माअ‍ेवादी महासचिव राम बहादुर थापा बादलले पनि आजको सभ्झौता पार्टिको केन्द्रीय कमिटी निणयै विपरित रहेको भन्दै यसको जनताले विरोध गर्ने बताउनुभयो । आजको सम्झौता जनताको शान्तिको अपेक्षा विपरित भएको उहाँको भनाइ थियो । नेता बादलले आजको सम्झौता जनताको हितमा नभएको दावी गर्नुभयो । 

दलहरुको चिन्ता कार्यन्वयनमा 

यता दलहरु बिच शान्ति प्रक्रियामा सहमति भए लगत्तै दलका शिर्ष नेतृत्वले सहमतिलाइ कार्यन्वयमा लैजाने दृढता ब्यक्त गरेका छन् । 

बालुवाटारमा भएको बैठकपछि एकीकृत नेकपा माओवादीका अध्यक्ष पुष्पकमल दाहाल प्रचण्डले कार्यन्वयनको सुनिश्चिता भएकै कारण दलहरु बिच सहमति कायम भएका बताउनु भएको छ । उहाँले २०६३ साल असार २ गते सुरु भएको शान्ति प्रक्रियाको एउटा अध्याय आज पूर्ण भएको उल्लेख गर्नुभयो । प्रचण्डले बैद्य र बादलको विरोध भएपनि पार्टि भने एक ढिक्का रहेको दावी गर्नुभयो । बैद्यले पार्टि कार्यलयको सहमति कै आधारमा फरक मत राखेको उल्लेख गर्नुभयो । प्रचण्डले कार्यन्वयन गर्ने आधार नभइ सहमति नगरिएको उल्लेख गर्दै । कार्यन्वयन गर्न सकिने दावी गर्नुभयो । 

बैठकपछि एमाले अध्यक्ष झलनाथ खनालले अब सहमति कार्यन्वयको चुनौती रहेकाले दलहरुले सहजताका साथ एकताबद्ध भएर दृढता पूर्वक लाग्नुपर्ने बताउनुभयो । एमाले कै बरिष्ट नेता एवम् पूर्व प्रधानमन्त्री माधव कुमार नेपालले सहमति कार्यन्यन गनुपर्ने भन्दै माओवादी महासचीव वादलको विरोध  सैद्धान्तिक मात्र भएको बताउनुभयो । 

नेपाली काँग्रेसका सभापति शुशिल कोइरालाले एउटा ऐतिहासिक निणर्य भएको भन्दै दलहरुले राष्ट्रपतिको जिम्मेवारी बोध गरेको उल्लेख गर्नुभयो । 

यसअघि आज सहमतिको प्रयास स्वरुप राजधानीको लाजिम्पाट स्थित ¥याडिसन होटलमा दिउँसो शिर्ष नेताहरुको बैठक बसेको थियो । बैठकले आज साँझको बैठकका लागी आवश्यक सहमतिको डफ्ट तयार गरेको थियो । 

बैठकमा एकिकृत नेकपा माओबादीका अध्यक्ष पुष्पकमल दाहा प्रचण्ड, नेपाली कंग्रेशका सभापति सुशिल कोइराला र नेकपा एमालेका अध्यक्ष झलनाथ खनालको सहभागीता थियो । यसअघि हिजो पनि दलहरु को बैठक बसेपनि समय अभाव भएपछि आज सम्मका लागि स्थगित गरिएको थियो ।
दलहरु बिच भएको सहमति पत्र जस्ताको तस्तै

शान्ति प्रक्रिया लगायतका विषयमा राजनीतिक दलहरुको सहमति

शान्ति प्रक्रिया र संविधान निर्माणको जिम्मेवारी पूरा गर्न राष्ट्रिय सहमति अपरिहार्य छ । यस सन्दर्भमा  नेपालको शान्ति प्रक्रियालाई सार्थक निष्कर्षमा पु¥याई संविधान निर्माण लगायतका राजनीतिक प्रक्रियाहरुलाई अगाडि बढाउनु पर्ने तथ्य प्रष्ट नै छ । अतः विस्तृत शान्ति सम्झौता, नेपालको अन्तरिम संविधान, २०६३ तथा विभिन्न समयमा राजनीतिक दलहरुका बीच भएका सहमति अनुरुप शान्ति प्रक्रियाका बाँकी कामहरु तुरुन्त सम्पन्न गर्दै संविधान निर्माण र राष्ट्रिय सहमतिको राजनीतिलाई अघि बढाउन निम्नलिखित सहमति गरेका  छौं :

१. माओवादी सेनाका लडाकुहरुको समायोजन र पुनःस्थापना

क) शिविरमा रहेका माओवादी सेनाका लडाकुहरुको विवरण अद्यावधिक गरिने छ  ।

ख) समायोजनमा सामेल हुने माओवादी सेनाका लडाकुहरुको संख्या बढीमा ६५०० (छ हजार पाँचसय) सम्म हुनेछ । समायोजन नेपाली सेना अन्तर्गत महानिर्देशनालयमा हुनेछ । त्यसमा सुरक्षा निकायबाट ६५ प्रतिशत र माओवादी सेनाका लडाकुहरुबाट ३५ प्रतिशतको संख्या रहनेछ ।  महानिर्देशनालयको कार्य विकास–निर्माण, बन सुरक्षा, औद्योगिक सुरक्षा र विपद् व्यवस्थापन हुनेछ ।  

ग) समायोजनमा सामेल हुने माओवादी सेनाका लडाकुहरुले सम्बन्धित सुरक्षा निकायको मापदण्ड व्यक्तिगत आधारमा पूरा गर्नुपर्ने छ । तर उमेर, शिक्षा र वैवाहिक स्थितिको मापदण्डमा लचकता अपनाइने छ ।  माओवादी सेनाका लडाकुमा भर्ना हुँदाको मितिमा तोकिएको दर्जाका लागि शिक्षामा एक तहसम्म र उमेरमा तीन बर्षसम्मको बढी उमेरमा लचकता अप्नाइने छ ।

घ) समायोजनमा सामेल हुनेहरुको दर्जा निर्धारण सम्बन्धित सुरक्षा निकायको मापदण्ड अनुसार हुनेछ । सुरक्षा अङ्गमा अधिकृत र अन्य दर्जामा समायोजन गर्दा सुरक्षा निकायको प्रचलित व्यवस्था र हालका अधिकृत र अन्य दर्जाका व्यक्तिहरुको वृत्ति विकासमा नकारात्मक असर नपर्ने गरी दर्जा निर्धारण गरिनेछ । लडाकुहरुको समयावधि गणना अनमिनले प्रमाणिकरण गर्दा उल्लेख गरेको प्रवेश मितिको आधारमा गरिने छ ।

ङ) सुरक्षा निकायको ब्रिजिङ कोर्स र तालिम पूरा गरेपछि लडाकुहरुले सुरक्षा निकायको तोकिएको तहको जिम्मेवारी पाउनेछन् । ब्रिजिङ कोर्ष र तालिम सम्बन्धित सुरक्षा निकायले दिनेछ । 

च) समायोजनको प्रक्रिया शुरु भएपछि शिविरमा रहेका सबै हतियार स्वतः नेपाल सरकारको मातहतमा आउनेछन्  ।

२) माओवादी सेनाका लडाकुहरुको पुनःस्थापना

क) पुनःस्थापनामा सामेल लडाकुहरुका लागि शिक्षा, तालिम एवं व्यवसायिक अवसरहरुको प्याकेजको विकल्प उपलब्ध गराइने छ । सो प्याकेजको  स्वरुप एवं समयावधि हेरी रु. ६ देखि ९ लाखसम्मको मूल्य हुनेछ । 

ख) उक्त प्याकेजको सट्टा नगद रकम लिई स्वैच्छिक अवकाशमा जानेहरुका लागि विभिन्न तहको जिम्मेवारी  हेरी सबभन्दा माथिल्लो तह तथा त्यसभन्दा तल तीन तह निर्धारण गरिने छ तथा  सबभन्दा माथिल्लो तहका लडाकुहरुलाई रु. ८ लाख एवं त्यसपछिका तहमा रहेकाहरुलाई क्रमशः रु.७ लाख, रु.६ लाख र रु.५ लाख   दिइने छ । सो रकम दुई आर्थिक वर्षमा दुई किस्तामा उपलब्ध गराईने छ । यससम्बन्धमा दुई दिनभित्र विशेष समितिको बैठकबाट विधिवत् निर्णय गरिनेछ ।  

३) समूह विभाजन

समायोजन र पुनःस्थापनामा सामेल हुनेहरुको सम्बन्धमा विशेष समितिको बैठकबाट प्रक्रियागत विषयमा सात दिनभित्र निर्णय गरी समूह विभाजनको काम प्रारम्भ हुनेछ । समूह विभाजनको काम २०६८ साल मंसीर ७ गते भित्र सम्पन्न गरिनेछ ।

४) सहमति बमोजिमका आयोगहरुको गठन

क) विस्तृत शान्ति सम्झौता बमोजिम सत्य निरुपण तथा मेलमिलाप आयोग तथा वेपत्ताहरुको छानबिन आयोग सम्बन्धी विधेयक मेलमिलापको भावना अनुरुप व्यवस्थापिका संसदबाट सहमतिको आधारमा पारित गरिनेछ । यी आयोगहरु सहमतिको आधारमा एक महिना भित्र गठन गरिनेछ ।

ख) विस्तृत शान्ति सम्झौता र नेपालको अन्तरिम संविधान, २०६३ को मर्म र भावना अनुसार द्वन्द्वकालका मुद्दाहरु हेरिनेछ । 

५) द्वन्द्व पीडितहरुलाई राहत–सहयोग

सशस्त्र द्वन्द्वकालमा द्वन्द्वका कारण मारिएका व्यक्तिका परिवार, अपाङ्ग र अङ्गभङ्ग भएका व्यक्तिहरु, वेपत्ता व्यक्तिका परिवार, विस्थापित व्यक्ति र परिवार एवं सम्पत्ति नष्ट भएका परिवारलाई न्यायोचित किसिमले विना भेदभाव राहत–सहयोग उपलब्ध गराइनेछ  । विस्तृत शान्ति सम्झौता पश्चात् यसरी दिइने राहत–सहयोग कसैलाई भेदभाव नगरी समानताका  आधारमा उपलब्ध गराइनेछ । 

६. विगतका सहमतिहरुको कार्यान्वयन र विश्वासको वातावरण सिर्जना गर्ने 

क) सशस्त्र द्वन्द्वको क्रममा एकीकृत नेपाल कम्युनिष्ट पार्टी (माओवादी) कोे कब्जामा रहेका निजी तथा सार्वजनिक घर, जग्गा सम्बन्धित व्यक्ति र संस्थालाई फिर्ता गरी भोग चलन गराउन एकीकृत नेपाल कम्युनिष्ट पार्टी (माओवादी) ले संस्थागत निर्णय गरी २०६८ साल मंसिर ७ गते भित्र सम्बन्धित व्यक्ति र संस्थालाई उपलब्ध गराइने छ । कब्जा भएको अवधिको जग्गाको आयस्ता बापत सम्बन्धित व्यक्तिलाई उपयुक्त क्षतिपूर्ति दिइने छ ।

ख) विस्तृत शान्ति सम्झौता, नेपालको अन्तरिम संविधान, २०६३ र वैज्ञानिक भूमिसुधारको मर्म र भावना अनुसार किसानहरुको अधिकार सुरक्षित गरिनेछ । 

ग) एकीकृत नेपाल कम्युनिष्ट पार्टी (माओवादी) को योङ्ग कम्युनिष्ट लिग (वाई.सी.एल्.) को अर्ध–फौंजी संरचना र गतिविधिको अन्त्य गरिने छ  तथा त्यसको नियन्त्रणमा रहेका सबै नीजी र सार्वजनिक एवं सरकारी भवन र जग्गा २०६८ साल मंसिर ७ गते भित्र खाली गरी सम्बन्धित संस्था र व्यक्तिलाई फिर्ता गरिनेछ ।

घ) पहिलेको सहमति बमोजिम यातायात व्यवस्था विभागमा अभिलेख राखिएका एकीकृत नेपाल कम्युनिष्ट पार्टी (माओवादी) को प्रयोगमा रहेका गाडीहरु २०६८ साल मंसिर ७ गते भित्र नियम–कानून अनुसार नियमित गरिनेछ । नियमित नभएका गाडीहरु सरकारले जफत गर्नेेछ । शिविरमा रहेका गाडीहरु नेपाल सरकारको मातहतमा आउनेछन् ।

ङ) कब्जा घर जग्गा फिर्ता गर्ने सहमतिको कार्यान्वयन भए नभएको अनुगमन गर्ने तथा कार्यान्वयन नभएको भए कार्यान्वयन गराउने जिम्मेवारी स्थानीय प्रशासनको हुनेछ । यसमा राजनीतिक दलहरुले सहयोग गर्नुपर्ने छ ।  

७) संविधान निर्माण र राष्ट्रिय सहमतिको सरकार

क) शान्ति प्रक्रिया र संविधान निर्माणको कामलाई सार्थक निष्कर्षमा पु¥याउन राजनीतिक दलहरुका बीचको सम्बादलाई निरन्तरता दिइने  छ । यसका लागि उच्चस्तरीय राजनीतिक संयन्त्र गठन गरिनेछ । 

ख) संविधान निर्माणको कार्यलाई तीब्रता दिइने छ । संविधानसभाबाट सहमतिको आधारमा अविलम्ब विज्ञहरुको टोली बनाई राज्यको पुनःसंरचनाबारे सुझाव लिइने छ र एक महिनाभित्र नयाँ संविधानको मस्यौदा निर्माणको काम आरम्भ गरिने छ ।

ग) शान्ति र संविधान निर्माण प्रक्रिया उपर्युक्त किसिमले अगाडि बढ्ने क्रमसंगै राष्ट्रिय सहमतिको सरकार निर्माण प्रक्रिया अगाडि बढाइने छ ।

Political Parties' Agreement on the Issues including Peace Process

National consensus is essential to carry out the duties of concluding peace process and constitution writing. With this in context, it is very clear that the national politics should be steered ahead by reaching the peace process to the logical conclusion and writing constitution. Therefore, we, by adhering to the Comprehensive Peace Accord, interim Constitution of Nepal 2063 and various other agreements reached among the political parties, reached the following agreement in order to move ahead national consensus politics with constitution writing and settling of the remaining tasks of the peace process:

1. Integration of the Maoist combatants

The details about the Maoist combatants lodged at various cantonments will be updated.

The number of the combatants to for the integration shall be maximum 6,500. They shall be integrated into the general directorate under the Nepal Army where there will be 65 percent from the security bodies while 35 from the Maoist combatants. The function of the general directorate shall be in the sector of development works, forest and industrial security and disaster management.

The Maoist combatants willing integration need to personally fulfill the standard of the concerned security bodies. However, the rule on age, education and marital status of the combatants shall be flexible. The rule on the educational status shall be made flexible for one more status while the age up to three years from the post designated to the combatants when they were recruited in the Maoist.

 The post/rank of the fighters to be integrated shall be determined as per the standard of the concerned security body. While integrating into the post of officer and others in the security body, the post shall be determined in a way that shall not render negative impact on existing system of the security body, current officer and the career development of the others from other post.

After completing the bridge course and training, the combatants shall be assigned the responsibilities of fixed level/post of security body. The bridge course and training shall be provided by the concerned security bodies.

All weapons in the cantonments shall automatically come under Nepal government's control after the initiation of the integration process.

3. Rehabilitation of the Maoist Combatants

The Maoist combatants opting for the integration shall be provided an alternative package with education, training and professional opportunities. The package as per its nature and time shall worth Rs 600,000 to 900000.

            (b) Those who want to go for voluntary retirement by taking cash instead of the package would be categorized into different groups comprising the highest group and three levels below that by considering their responsibilities at different levels. An amount of Rs. 800,000 would be provided to the combatants of the highest level and Rs. 700,000, Rs. 600,000 and Rs. 500,000 to combatants in successive levels in that order. The amount would be made available in two installments in two fiscal years. A due decision would be made within two days regarding this topic by a meeting of the special committee.

3. Regrouping

            Decisions on procedural matters regarding those combatants who want to be included under the integration and rehabilitation shall be taken in seven days by a meeting of the special committee and the task of regrouping the combatants shall be started. The work of regrouping shall be completed by November 23, 2011.

4. Constitution of commissions as per the agreement

            a) The Bill pertaining to the Truth and Reconciliation Commission and the Commission on the Disappeared in accordance with the Comprehensive Peace Accord shall be passed from the Legislature-Parliament as per the spirit of the reconciliation. These commissions shall be established within one month on the basis of agreement.

            b) Cases from the conflict period shall be dealt with as per the letter and spirit of the Comprehensive Peace Accord and the Interim Constitution of Nepal, 2007.

5. Relief assistance to conflict victims

           

Relief assistance shall be provided to the families of the people killed due to the conflict during the time of the armed conflict, to people rendered disabled and to those maimed, to the families of the disappeared, to displaced people and families and to families that have lost property without any discrimination in a reasonable manner. The relief to be provided thus after the Comprehensive Peace Accord shall be made available on the basis of equality and without discrimination against anybody.

 

6. Implementation of the past agreements and creation of environment of trust

            a) The Unified CPN (Maoist) shall take an institutional decision regarding returning the private and public houses and land under the control of the UCPN (Maoist) in course of the armed conflict to the individuals and institutions concerned for their use and these properties shall be handed over to the individuals and the institutions concerned within November 23, 2011. The individuals concerned shall be provided appropriate compensation by way of the income from the land for the period it was seized.

            b) The rights of the peasants shall be protected as per the letter and spirit of the Comprehensive Peace Accord, the Interim Constitution of Nepal, 2007 and scientific land reforms.

C) The para-military structure of the Young Communist League of the Unified Communist Party of Nepal (Maoist) shall be dismantled and its activities terminated while all the private, public and government property under its control shall be vacated and returned to the rightful owners by November 23, 2011.

d) The vehicles which are registered at the Department of Transport Management and are in use by the Unified Communist Party of Nepal (Maoist) shall be regularized by November 23, 2011 as per the past agreement. Those unregulated vehicles shall be seized by the government. Vehicles in the cantonments shall be brought under the control of the Nepal Government.

e) The local administration shall be authorized for carrying out the monitoring of the enforcement status of the agreement on returning the seized property to the owners. It would be the responsibility of the local administration to get the agreement enforced in case it is not enforced. The political parties shall cooperate and assist the local administration in this task.

7. Constitution drafting and the government of national consensus

a) Talks and negotiatons among the political parties shall be continued to take the peace process and constitution drafting process to a positive conclusion. A high-level political mechanism shall be formed for this.

b) The task of drafting the constitution shall be accelerated.  A team of experts shall be formed on the basis of consensus to give suggestions to the Constituent Assembly to this effect and the task of making the draft of the new constitution shall be initiated within the next one month.

c) The process of the formation of the national consensus government shall be initiated simultaneously with the peace process and the constitution drafting process.
